Welcome to Umpteen Things, where there are umpteen ways to find something useful, unique, stylish, handcrafted, or simply too good to leave behind.
Umpteen Things is a brand operated by Shemice’s Services Personal & Business LLC. Throughout these Terms of Service, the terms “Umpteen Things,” “we,” “us,” and “our” refer to Umpteen Things and Shemice’s Services Personal & Business LLC.
We operate this website and online store, including all related information, content, features, tools, products, and services offered through it, collectively referred to as the “Services.” Our store is powered by Shopify, which provides the e-commerce platform that allows us to offer our products and Services to you.
These Terms of Service, together with any policies referenced in them, explain your rights and responsibilities when visiting our website, creating an account, communicating with us, or purchasing from Umpteen Things.
Please read these Terms carefully. They include important information concerning orders, payments, shipping, intellectual property, warranty disclaimers, and limitations of liability.
By visiting, browsing, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. Umpteen Things may offer a variety of products, including apparel, accessories, handcrafted goods, candles, personal-care products, pre-loved merchandise, consignment items, seasonal products, customized products, and other retail merchandise.
We make reasonable efforts to display and describe our products accurately. However, product colors and appearances may vary depending on your device, monitor settings, lighting, photography, and other factors outside our control.
Handcrafted Products
Handcrafted products may have minor differences in color, texture, scent, finish, placement, weight, shape, or appearance. These natural variations are part of the handmade process and do not automatically mean that a product is defective.
Pre-Loved and Consignment Products
Pre-loved and consignment products have been previously owned or used unless the listing states otherwise. These products may have normal signs of wear, aging, handling, storage, or prior use.
We make reasonable efforts to disclose known material flaws or conditions in the product description and photographs. Customers are responsible for carefully reviewing all descriptions, measurements, photographs, condition notes, and available details before purchasing.
Candles and Personal-Care Products
Candles, wax products, body products, and similar items must be used only as directed and in accordance with all warnings and instructions supplied with the product.
Never leave a burning candle unattended. Keep candles away from children, pets, drafts, flammable materials, and unstable surfaces.
Personal-care products are intended for external use unless expressly stated otherwise. Customers should review ingredient information and discontinue use if irritation occurs. Information provided through our Services is for general informational purposes and is not medical advice or a promise to diagnose, treat, cure, or prevent any medical condition.
Product Availability
Product descriptions, availability, quantities, features, pricing, and specifications may be updated at any time without notice.
We reserve the right to:

Restrict sales by customer, household, geographic location, or jurisdiction;

SECTION 3 — ORDERS AND ORDER ACCEPTANCE
Placing an order constitutes an offer to purchase products from Umpteen Things. An order is not considered accepted merely because an order confirmation or automated message has been generated.
We reserve the right to accept, decline, hold, investigate, modify, or cancel an order for lawful reasons, including:

Inventory errors or product unavailability;

We may request additional information or identity verification before processing an order. Failure to provide requested verification may result in cancellation.
Payment must be authorized and successfully processed before an order is accepted and fulfilled.
Please review your cart carefully before submitting your order. This includes product names, sizes, colors, quantities, customization details, shipping addresses, billing information, discounts, and totals.
Once an order has entered processing, production, personalization, packing, or fulfillment, we may be unable to cancel or change it.
When an order is declined, modified, held, or canceled, we will make reasonable efforts to contact you using the email address, telephone number, billing information, or other contact information submitted with the order.
Any refund, return, exchange, store-credit, cancellation, or final-sale determination will be governed by our Refund Policy.
Unless expressly authorized by us in writing, purchases are intended for personal or household use and not for unauthorized commercial resale or export.
SECTION 4 — PRICES, PROMOTIONS, AND BILLING
Prices, discounts, promotions, coupon codes, and product availability may change without notice.
The price charged will generally be the price displayed when the order is submitted, subject to correction of obvious errors, payment processing, inventory confirmation, and applicable promotional terms.
Unless otherwise stated, displayed prices do not include:

Promotional offers may have separate eligibility requirements, exclusions, expiration dates, quantity limits, or other conditions. When promotional terms conflict with these Terms, the specific promotional terms will govern that promotion.
You agree to provide accurate, current, and complete purchase, billing, shipping, and account information.
By submitting payment information, you represent and warrant that:

Charges incurred will be honored; and

You will pay all authorized charges, taxes, shipping costs, and applicable fees.
We are not responsible for overdraft fees, foreign-transaction fees, payment-provider fees, or other charges imposed by your bank, card issuer, or payment service.
SECTION 5 — SHIPPING, DELIVERY, AND RISK OF LOSS
Processing and delivery estimates are provided as estimates only and are not guaranteed unless we expressly agree otherwise in writing.
Processing times and shipping times are separate. Handcrafted, personalized, made-to-order, seasonal, or high-demand products may require additional processing time.
We are not responsible for delays caused by circumstances outside our reasonable control, including:

Shipping carriers;

Severe weather;
-
Natural disasters;
-
Labor disruptions;
-
Customs processing;
-
Transportation interruptions;
-
Incorrect or incomplete addresses;

Government actions;
-
Carrier volume;
-
Supply interruptions; or

Other unforeseen events.
Customers are responsible for providing a complete and accurate shipping address. Additional shipping charges resulting from an incorrect, incomplete, refused, or undeliverable address may be the customer’s responsibility.
Once an order is transferred to the shipping carrier, title and risk of loss pass to the customer to the fullest extent permitted by law.
When tracking information shows an order as delivered, the customer should first check the delivery location, household members, neighbors, property management, and the shipping carrier. Umpteen Things is not automatically responsible for packages that are lost or stolen after confirmed delivery.
Claims involving damaged, missing, or incorrectly delivered packages should be reported to us promptly and may require photographs, packaging, tracking information, written statements, or cooperation with the carrier’s investigation.
Local delivery or pickup may be offered within portions of the Dallas–Fort Worth Metroplex. Availability, pricing, delivery windows, identification requirements, and pickup instructions may vary and will be communicated separately.
SECTION 6 — INTELLECTUAL PROPERTY
The Services and their content—including trademarks, business names, logos, slogans, product names, product designs, photographs, graphics, videos, audio, written content, product descriptions, reviews, artwork, page layouts, and other materials—are owned by or licensed to Umpteen Things, Shemice’s Services Personal & Business LLC, Shopify, or their respective licensors.
These materials are protected by copyright, trademark, trade-dress, and other applicable intellectual-property laws.
You may use our Services only for lawful, personal, and noncommercial purposes.
Without prior written permission, you may not:

Copy product photographs or descriptions;

Modify or create derivative works from our materials;

Distribute, sell, license, or commercially exploit our content;

“Umpteen Things,” associated logos, product names, designs, and slogans are trademarks or brand assets of Umpteen Things or Shemice’s Services Personal & Business LLC.
Shopify’s name, logos, product names, and service names belong to Shopify. All other trademarks belong to their respective owners.
No rights or licenses are granted except as expressly stated in these Terms.
SECTION 7 — OPTIONAL AND THIRD-PARTY TOOLS
We may provide access to tools, applications, payment services, integrations, or features offered by third parties.
We may not monitor, control, operate, or have input into these third-party tools.
Access to optional tools is provided on an “as is” and “as available” basis without warranties, endorsements, representations, or conditions of any kind.
Your use of optional tools is at your own discretion and risk. You are responsible for reviewing and accepting the terms and privacy practices of the relevant third-party provider.
We may introduce new tools, resources, features, or services in the future. Unless otherwise stated, those additions will be considered part of the Services and governed by these Terms.

We do not control and are not responsible for reviewing, verifying, or guaranteeing the accuracy, safety, quality, legality, availability, or practices of third-party websites, products, services, or content.

Umpteen Things is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Umpteen Things.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Umpteen Things, including any injury, damage, or loss resulting from purchased products and services.
You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Umpteen Things.
SECTION 10 — PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because our Services are hosted by Shopify, Shopify may collect and process personal information relating to your access to and use of the Services to operate, secure, maintain, and improve the platform.

When you submit, post, upload, email, tag, transmit, or otherwise provide reviews, photographs, videos, testimonials, ideas, suggestions, comments, proposals, or other content, collectively referred to as “Feedback,” you grant Umpteen Things a perpetual, worldwide, nonexclusive, transferable, sublicensable, royalty-free license to use, reproduce, edit, adapt, publish, translate, distribute, display, and promote that Feedback in any lawful medium.
This may include using customer reviews, photographs, or testimonials to operate, improve, advertise, and promote our products and Services.
You represent and warrant that:

Occasionally, information available through the Services may contain typographical errors, inaccurate information, omissions, outdated details, or technical mistakes involving:

Termination does not eliminate obligations or amounts incurred before the termination date.
Provisions that by their nature should continue after termination will survive, including provisions concerning intellectual property, Feedback, disclaimers, limitations of liability, indemnification, governing law, privacy, and amounts owed.

Although we make reasonable efforts to provide accurate information, we do not guarantee that all information will always be complete, current, accurate, useful, uninterrupted, secure, or error-free.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent legally permitted.
SECTION 17 — LIMITATION OF LIABILITY
To the fullest extent permitted by law, Umpteen Things, Shemice’s Services Personal & Business LLC, Shopify, and their respective owners, officers, directors, employees, partners, affiliates, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, punitive, special, exemplary, or consequential damages.
This includes, without limitation:

Delayed, missing, stolen, or damaged shipments;

Errors or omissions in content;

Unauthorized access to account information;

Third-party tools, websites, or services; or

Content made available through the Services.
These limitations apply regardless of whether a claim is based in contract, tort, negligence, strict liability, statute, or another legal theory, and even when the possibility of damages was communicated.
Nothing in these Terms excludes liability that cannot legally be excluded.
SECTION 18 — INDEMNIFICATION
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Umpteen Things, Shemice’s Services Personal & Business LLC, Shopify, and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, damages, judgments, and reasonable legal fees arising from:

If any provision of these Terms is determined to be unlawful, void, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law.
The unenforceable portion will be considered severed, and the remaining provisions will continue in full force and effect.
SECTION 20 — WAIVER AND ENTIRE AGREEMENT
Our failure to exercise or enforce a right or provision does not waive that right or provision.
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies or rules posted through the Services, constitute the entire agreement concerning your use of the Services.
They supersede prior or contemporaneous agreements, communications, representations, or proposals concerning the same subject matter, whether oral or written.
Any ambiguity will not automatically be interpreted against the party responsible for drafting these Terms.

You may not assign, transfer, delegate, or license your rights or obligations under these Terms without our prior written consent.
Any unauthorized attempted assignment is void.

These Terms and any separate agreements through which we provide Services will be governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law principles.
To the extent permitted by law, disputes will be brought in the appropriate state or federal courts serving Dallas County, Texas.
You consent to the personal jurisdiction and venue of those courts.

They do not limit, expand, or otherwise change the meaning of these Terms.
SECTION 24 — CHANGES TO THESE TERMS
The most current version of these Terms of Service will be available on this page.
We reserve the right to update, revise, replace, or remove portions of these Terms by posting the updated version through our Services.
When required by law, we will provide notice of material changes and identify when those changes become effective.
Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
